APPELLATE LAW
Wimer & Jobe has successfully handled appeals in both
state and federal courts. Our attorneys have been involved
in federal appeals in the 4th Circuit, 5th Circuit, 11th Circuit,
and before the United States Supreme Court, as well as appeals
in North Carolina and Texas appellate courts.
CATASTROPHIC INJURIES
Catastrophic injury cases involve wrongful death or injuries
that require significant medical treatment, and which often
have a long-term or permanent effect on an injured person's
life. Most personal injury cases do not involve catastrophic
injuries. The majority of personal injury cases we accept
have damage potential in excess of $100,000.00. For efficiency
purposes, smaller personal injury cases often are referred
to other attorneys who routinely handle those types of cases.
Catastrophic injury cases are handled by Wimer & Jobe
on a contingent-fee basis, and attorney fees are owed only
as a percentage of recovery.
CLASS ACTIONS
A class action refers to any case in which one or more plaintiffs
seek to represent a large group of persons or businesses in
a lawsuit. Class actions may be filed in state or federal
courts. Normally, a class action is filed when a large number
of people have been adversely affected in the same way.
Many of our class actions are filed against large corporations
and multi-national conglomerates. Examples of class actions
in which Wimer & Jobe has been involved include:
- Recovery of wages and overtime wages on behalf of employees
- Antitrust claims against long-distance telephone companies
to recover universal service charges
- Claims against telephone companies for deception in billing
and collecting surcharges
- Price-fixing claims on behalf of purchasers of tires
- Price-fixing claims on behalf of purchasers of rubber
products
- Claims against mortgage servicing company for fraud and
deceptive acts
COMPLEX LITIGATION
Complex litigation involves complicated facts or extremely
difficult legal issues. Most complex litigation occurs between
businesses and may involve contracts, trade secrets, employment,
construction or antitrust issues. Complex litigation often
encompasses lawsuits in many jurisdictions, including foreign
countries, and may involve arbitration proceedings.
The attorneys at Wimer & Jobe have successfully handled
complex litigation in state and federal courts, as well as
on appeal.
CONSUMER LAW
Consumer law covers situations in which an individual or
small business has been unfairly treated or deceived. When
a large number of consumers have been treated illegally in
a similar fashion, consumer claims may be litigated as class
actions.
A few examples of our consumer lawsuits include:

Employment law is a vast category that includes any dispute
between an employer and an employee. Wimer & Jobe has
successfully represented both employers and employees in state
and federal court. A significant portion of Wimer & Jobe’s
practice is devoted to employment law, including:
- wage and overtime issues
- race discrimination
- sex discrimination
- sexual harassment
- age discrimination
- FMLA violations
- noncompete agreements
- wrongful termination in violation of public policy
- separation agreements and severance packages
- incorrect designation as independent contractor
INSURANCE CLAIMS
Wimer & Jobe has been involved in a significant number
of cases involving insurance claims. On most occasions, we
represent people whose insurance claims have been unfairly
denied or delayed. Below are examples of cases in which we
have been hired to represent clients in claims against their
insurance companies:
- failure to pay disability benefits
- failure to pay property damage resulting from fire
- failure to pay for water damage
- failure to pay for vandalism to property and lost rent
INTERNATIONAL LAW
We have represented clients in transactions crossing national
borders, as well as international litigation and arbitrations.
Our clients' legal needs have taken us to Mexico, Germany,
India, and Canada. In this ever-expanding global economy,
it is important that clients retain counsel who have experience
in international law. While this is not a large portion of
our practice, we do have capabilities to handle our clients'
international needs.
